Miami Prescription Drug Crime Attorney

Call (305) 783-3301 for Experienced & Skilled Legal Representation

Due to the devastating impact of the opioid epidemic throughout the United States, law enforcement agencies have been going after overprescribing doctors, pill mills, and even those who are addicted. Unfortunately, there are many instances where innocent people are accused of committing a prescription drug crime. In order to avoid harsh penalties associated with a conviction, it is crucial to hire an aggressive and knowledgeable criminal defense attorney.

At Mitchell & West LLC, our Miami drug crime lawyer is ready to protect your rights and future. Our goal is to either get your entire case dismissed or your penalties reduced. Not only does a conviction lead to a prison sentence and fines, but also a permanent criminal record which can negatively affect your career and personal life. Do not hesitate to let us fight for you immediately.

Florida Prescription Drug Laws & Penalties

It is considered a crime to possess a controlled substance without a valid prescription from a certified medical practitioner. Prescription drugs are classified as a Schedule II drug, which means they have a high potential for abuse that results in physical and psychological dependence and medical use is significantly restricted. These include medications such as fentanyl, OxyContin, hydrocodone, morphine, Adderall, and Percocet.

Possession of a prescribed substance without a valid prescription is a third-degree felony, punishable by a prison sentence of up to five years and a maximum fine of $5,000. Possession with intent to sell is a second-degree felony, which results in a maximum prison term of 15 years and a fine of up to $10,000.

When a person is found in possession of a significant amount of illegal prescription substances, police will most likely charge him/her with trafficking as opposed to possession with intent to sell. For instance, if you are arrested for being in possession of 14 grams of hydrocodone without a legal prescription, you will face a first-degree felony, punishable by a maximum 30-year prison sentence.
